Terms of Service
The agreement between you and us for the use of CollegeForge.
Last updated: October 21, 2026
Effective date: October 21, 2026
These Terms of Service (these “Terms”) form a binding agreement between you and CollegeForge (“CollegeForge,” “we,” “us,” or “our”) governing your access to and use of the collegeforge.ai website, the CollegeForge application, and any related services (collectively, the “Service”). Please read them carefully.
1. Acceptance of These Terms
By creating an account, or by accessing or using the Service, you agree to be bound by these Terms and acknowledge our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, do not use the Service.
2. Eligibility, Minors, and Parental Consent
2.1 Minimum age
You must be at least 13 years old to create an account or use the Service. The Service is not directed to children under 13.
2.2 Users under 18
If you are at least 13 but under 18 years old (or under the age of majority where you live), you may use the Service only with the permission of your parent or legal guardian (“Parent”), and your Parent must review and agree to these Terms. By allowing a minor to use the Service, a Parent agrees to these Terms on the minor’s behalf and on their own behalf, and is responsible for the minor’s use of the Service, including any purchases.
2.3 Adults acting for others
If you create or link to an account on behalf of a student, or accept these Terms on behalf of a school or other organization, you represent that you have the authority to do so.
3. Accounts
- You must provide accurate and complete information when you register and keep it up to date.
- You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
- Accounts are personal to you and may not be shared, sold, or transferred.
- You must notify us promptly at legal@collegeforge.ai if you suspect unauthorized use of your account.
4. School and Organizational Accounts
Where a school, school district, or other organization (a “School”) makes the Service available to you under a separate written agreement with us, that agreement governs the School’s use of the Service and prevails over these Terms to the extent of any conflict. The School may have access to information associated with accounts it provides, as described in our Privacy Policy. Our handling of student records provided by a School is governed by the Family Educational Rights and Privacy Act and applicable state student privacy laws, as set out in our Privacy Policy.
5. License to Use the Service
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial educational purposes. All rights not expressly granted to you are reserved by CollegeForge and its licensors.
6. Acceptable Use
You agree not to, and not to permit or assist any other person to:
- copy, scrape, harvest, redistribute, sell, or resell any part of the Service or its content;
- access or attempt to access another user’s account or information;
- interfere with or disrupt the Service, circumvent any usage limit or access control, or probe, scan, or test the vulnerability of the Service;
- reverse engineer, decompile, or disassemble the Service, except to the extent applicable law expressly permits;
- upload material that you do not have the right to upload, or that is unlawful, infringing, harassing, defamatory, obscene, or otherwise objectionable;
- use the Service to cheat, or to produce work that violates the academic integrity policy of your school or any testing organization;
- use automated means to access the Service, or use the Service to develop a competing product; or
- use the Service in violation of any applicable law.
7. Your Content
You retain all ownership rights in the content you enter or upload to the Service (“Your Content”). You grant CollegeForge a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and display Your Content solely as necessary to provide and improve the Service for you, including transmitting relevant content to our AI provider to generate responses. This license ends when Your Content is deleted from the Service, except to the extent retention is required by law. You represent and warrant that you have all rights necessary to submit Your Content and to grant this license, and that Your Content does not violate these Terms or any law.
If you send us suggestions or feedback about the Service, we may use them without restriction or obligation to you.
8. Our Intellectual Property
The Service, including all software, practice materials, text, graphics, and other content we provide, and all intellectual property rights in them, are owned by CollegeForge or its licensors and are protected by copyright, trademark, and other laws. These Terms do not grant you any right to use our names, logos, or trademarks.
9. Educational Guidance, AI-Generated Content, and No Guarantee of Outcomes
The Service provides study tools and informational guidance only. It does not provide admissions, financial, legal, medical, or other professional advice, and it is not a substitute for guidance from a qualified counselor, teacher, or professional. You acknowledge and agree that:
- Projected scores are estimates based on your performance on our practice materials. They are not predictions or guarantees of any official examination result.
- College matches and recommendations are informational. They do not predict any admission, scholarship, or financial aid decision, and no outcome is promised or implied.
- Third-party information may be incomplete or out of date. You should verify deadlines, requirements, costs, and other information directly with the relevant institution before relying on it.
- AI-generated content may be inaccurate. You are responsible for evaluating any output from the AI tutor or our guidance tools, and should verify anything important against your course materials or a teacher.
- Wellbeing features are not medical advice. Stop any activity that causes pain or discomfort, and consult a health professional about any health concern.
10. Plans, Fees, and Payment
Sign-up for the Service is not yet open. At launch, a free plan will be offered with limited use of certain features. Limits will be shown in the Service and may change. Paid plans are not yet available. Before any paid plan is offered, we will update these Terms to describe its pricing, billing interval, automatic renewal, cancellation, and refund terms, and we will disclose those terms clearly before you make any purchase. You will not be charged for any paid plan unless you affirmatively choose to purchase it. Arrangements with Schools are governed by the applicable written agreement.
11. Third-Party Services and Trademarks
The Service may rely on or link to third-party services and websites, which are governed by their own terms and policies. We are not responsible for third-party services. CollegeForge is an independent product and is not affiliated with, endorsed by, or sponsored by the College Board, ACT, Inc., or any college or university referenced in the Service. AP® and SAT® are registered trademarks of the College Board. ACT® is a registered trademark of ACT, Inc. All third-party trademarks are used for identification purposes only.
12. Copyright Complaints
We respect intellectual property rights and respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act, 17 U.S.C. § 512. To submit a notice, email legal@collegeforge.ai with: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the allegedly infringing material and information reasonably sufficient to locate it; (d) your contact information; (e) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner. We may terminate the accounts of repeat infringers.
13. Changes to and Availability of the Service
We may add, change, suspend, or discontinue any part of the Service at any time. We do not guarantee that the Service will be available without interruption or error. Where a change materially reduces the features of a paid plan you have purchased, we will provide advance notice as described in the terms applicable to that plan.
14. Suspension and Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or if necessary to protect the Service, our users, or others. Upon termination, your license to use the Service ends, and your information will be handled as described in Section 9 of our Privacy Policy. Sections 7 through 9, 11, and 15 through 18 survive termination.
15. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT ANY CONTENT (INCLUDING AI-GENERATED CONTENT) WILL BE ACCURATE OR RELIABLE, OR THAT USE OF THE SERVICE WILL RESULT IN ANY PARTICULAR EXAMINATION SCORE, ADMISSION DECISION, OR OTHER OUTCOME.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
16. Limitation of Liability and Indemnification
16.1 Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL COLLEGEFORGE OR ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, OPPORTUNITY, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).
These limitations do not apply to liability that cannot be limited or excluded under applicable law, including liability for gross negligence, willful misconduct, or death or personal injury caused by our negligence, where such limitation is prohibited.
16.2 Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless CollegeForge and its owners, officers, employees, and agents from any claims, losses, and expenses (including reasonable attorneys’ fees) arising out of Your Content or your violation of these Terms or applicable law.
17. Dispute Resolution and Governing Law
17.1 Informal resolution
Before starting any court proceeding, you and we each agree to first attempt to resolve any dispute arising out of or relating to these Terms or the Service (a “Dispute”) informally. The party raising the Dispute must send a written notice describing it and the relief sought (a “Notice of Dispute”). Notices to us must be sent to legal@collegeforge.ai with the subject line “Notice of Dispute.” We will send any notice to you at the email address associated with your account. If the Dispute is not resolved within 60 days after the Notice of Dispute is received, either party may begin a proceeding as provided below.
17.2 Governing law
These Terms, and any Dispute, are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, and by applicable federal law. This section does not deprive you of the protection of any mandatory consumer protection law of the state where you reside.
17.3 Venue
Any Dispute will be resolved exclusively in the state or federal courts located in the State of Delaware, and you and we consent to the personal jurisdiction of those courts. Either party may instead bring an individual claim in a small claims court of competent jurisdiction, and either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
18. General Provisions
- Changes to these Terms. We may revise these Terms from time to time. If we make material changes, we will update the effective date above and notify account holders by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes acceptance of them. If you do not agree, you must stop using the Service.
- Electronic communications. You consent to receive communications from us electronically, and agree that electronic communications satisfy any legal requirement that a communication be in writing.
- Entire agreement. These Terms, together with the Privacy Policy and any written agreement with a School, constitute the entire agreement between you and us regarding the Service.
- Severability. If any provision of these Terms is held unenforceable, it will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
- No waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
- Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, or by operation of law.
- Force majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control.
- Headings. Section headings are for convenience only and have no legal effect.
